This Privacy Policy describes how Smack Pet Food Inc., including its affiliates (“Smack” or “we” or “us” or “our”), collects, uses, and shares information about people who visit us online (“you” or “your”) at any website, mobile application, or other online platform that links to this Privacy Policy (together referred to as our “Site”) or who interact with a Smack marketing campaign, email, newsletter, in-person event, or other online or offline activity, offering, or publication. This Privacy Policy also describes the rights you may have regarding your personal information we process.

By visiting our Site or communicating with us in other ways, you agree to the collection, use, and processing of your personal information as described in the Privacy Policy. Smack operates under the laws of Canada and the United States. If you reside or are located in a different country, the data privacy laws of that country may be different. 1. scope of this privacy policy
This Policy describes how Smack collects, uses, and discloses your personal information and your choices regarding our processing of your personal information. We use the term “personal information” in this Privacy Policy to refer to information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, to you.
We collect personal information you submit to us directly, is gathered automatically online by cookies and similar internet technologies, and we receive from social media and other sources. For example, we collect information about you when you:
- Visit, shop, or set up an account on our Site;
- Sign up for our newsletter or to receive information about promotions and special events;
- Send us a question or ask us to contact you;
- Meet with us at an in-person event;

Collection by third-party websites. Our Site may contain links to third-party features and websites that we do not operate or control. The information practices and the content of these third-party websites are governed by their own privacy practices. Anonymized or aggregated information. Information that has been modified and aggregated with other peoples’ data in a substantial way so that the information can no longer reasonably be used to identify or be linked to an identifiable individual.
Employee and applicant information. Information about Smack personnel and job applicants.
Business-to-business communications (except where required by applicable law). Personal information we obtain about an individual who interacts with Smack in a business (not consumer or household) capacity, such as representatives of retailers, service providers, business partners, and media influencers.

Account Registration. When you set up a Smack online account, we ask for your:
- Name
- Email address
- Phone number
- Product preferences
- Comments or photos you submit to our Site
Online Purchases. When you place an order online, we will ask for your name, email address, phone number, contact preferences, and shipping information. You will be directed to the website of our authorized third-party payment processor to provide your card number and other payment information. We collect and retain limited card information for your transaction history.
Requests for Information. When you ask us for information about our products, we may ask for your name, email address, phone number, and information you’re interested in.
Surveys. When you participate in a survey, we ask for your opinions and thoughts and may also ask you to provide your name, contact information, photos, and other personal information.
Community Forums. The Site may offer publicly accessible blogs, community forums, comments sections, discussion forums, or other interactive features (“Community Forums”). You should be aware that any information that you post on a Community Forum will be read, collected, and used by others who access it. To request removal of your personal information from a Community Forum, contact us. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. See the section titled “How to Contact Us” below.
In-Person Events. If you attend an event or promotional booth sponsored by Smack, we may ask you to provide your name, phone number, email address, and information relating to the specific event or workshop.

We and third-party data analytics, digital advertising, and social media platforms we authorize place cookies, pixels, web beacons, and similar tracking technologies and device identifiers on your web browser or mobile device when you visit our Site. The types of data collected using automated online technologies may include, for example, the following:
- Randomly generated unique device and advertising ID numbers;
- Time and duration of your visits to the Site and Smack account;
- Pages viewed and functions used on the Site and Smack account;
- Device type, browser type, and operating system;
- Browsing and search history;
- Internet location from which you navigated to our Site and the location you went to when leaving our websites;
- Interactions with our advertisements placed on other websites and social media platforms;
- Data indicating when you open our email messages, any links or banners you click on, and if you save, forward, or delete the email.

4. personal information from other sources
Social Media Platforms. You can connect to our Site using your social media accounts such as TikTok, Pinterest, Instagram, YouTube, or Facebook. You can also log into our Site using single sign-on services such as Shopify. The sign-on services will authenticate your identity, provide you with the option to share certain personal information (such as your name and email address) with us, and pre-populate our sign-up form.
Marketing Databases and Other Commercial Sources. We may obtain your personal information from (and provide your personal information to) business partners and other third parties including the following:
- Programs that collect names, pet photos, email addresses, product ratings, and other information customers post on our website;
- Customer relationship management platforms that source information on possible leads from web scraping and retail stores;
- Advertising exchanges and other sources that collect data and draw inferences about your preferences and interests from your online and offline activities;
- Programs that integrate with social media platforms we use to identify potential influencers we may partner with.
5. how we use personal information we collect
We use personal information to conduct our business, stay in contact with our customers, and meet their expectations, including to:
- Create an effective and engaging shopping experience for you;
- Receive, fulfill, ship, and communicate with you about your orders;
- Process and complete registrations and requests, and send you related information, including confirmations;
- Send transactional messages, including responses to your comments, questions, and requests; provide customer service and support; and send you technical notices, updates, security alerts, and support and administrative messages;
- Send promotional and marketing communications including newsletters, offers, promotions, and announcements about contests and events;
- Provide, operate, maintain, improve, and promote the Site;
- Monitor and analyze Site usage and customer responses to email marketing to develop marketing and advertising strategies and campaigns;
- Personalize our online services and advertising, including by providing features, opportunities, and advertisements intended for your interests and preferences (see the sections titled “Targeted and Other Advertising” and “How to Restrict Cookies and Targeted Advertising”);
- Process and deliver contest or sweepstakes entries and rewards;
- Protect our Site and customers by investigating suspicious activity and unauthorized access;
- Comply with valid legal processes and respond to governmental requests.
6. sharing and disclosing personal information
Your personal information may be accessible to, or shared with, the categories of third parties described below, depending on your interactions with us. We do not sell your personal information to third parties for monetary consideration. We authorize third-party advertising, analytics, and social media platforms to use cookies and other internet tracking technologies on our Site to collect data about your device and how you use our Site. (See the information below and the sections titled “How We Use Cookies and Other Internet Technologies,” “Targeted and Other Advertising,” and “How to Restrict Cookies and Targeted Advertising.”)
Third-Party Service Providers. We engage third-party service providers to assist with various business operations and technology services including, for example, payment processing, email marketing, product shipment, hosting our Site, managing loyalty programs, and data management and storage. These providers may have access to your personal information to perform their services on our behalf, but they are not authorized to disclose or use personal information for their own commercial purposes.
Shopify Inc. Shopify provides the e-commerce platform we use for operating the Smack online store. Shopify collects the information you provide on our Site to place an order with Smack, save items to favorites, post a review, or otherwise interact or communicate with our store. Shopify also uses cookies and other technologies on our Site to collect data used for Site analytics and advertising services. Shopify has its own privacy policy for the personal information they receive to process your purchase and payment transaction with us. We recommend that you read Shopify’s posted statements so you can understand the manner in which your personal information will be handled: Shopify’s Terms of Service (https://www.shopify.com/legal/terms); and Privacy Statement (https://www.shopify.com/legal/privacy).
Payment Processors. If you choose Shopify or another service to process the payment for your purchase, that processor is responsible for collecting, encrypting, and storing your credit card and other personal information in compliance with the Payment Card Industry Data Security Standard (PCI-DSS) and generally accepted industry standards. Smack will receive limited card information (last four digits) to track your transactions.
Site Analytics. We authorize third-party analytics providers to use cookies to collect metrics and information regarding your use of the Site, including evaluating how Site visitors use our Site and customer account portal to develop new features, improve existing features, or inform sales and marketing strategies. Although the data they collect may not directly identify you, these third-party services may correlate your activities on our Site with your activities on other websites and applications. Online Advertisers. We use third-party advertising companies to serve advertisements on our Site and on selected websites and mobile applications operated by others. These companies use cookies and similar tracking technologies to collect information about your online activities over time and across different websites and devices which they use to build a profile of your interests and preferences and deliver advertisements targeted to you (referred to as “targeted advertising”). You can opt out of the use of cookies for targeted advertising purposes when you visit our Sites as explained in the section titled “How to Restrict Cookies and Targeted Advertising.’
Social Media Platforms. We use the Meta (Facebook) pixel and other social media cookies to collect, for example, purchase information, web activity, IP address, device and browser characteristics, and timestamps of visits. These cookies help us to analyze the effectiveness of advertisements we post on social media. You can disable these on your browser as described in “How to Restrict Cookies and Targeted Advertising.” For information about how Facebook cookies operate and the Meta Privacy Policy, see https://www.facebook.com/privacy/policy/.
Business Partners. We may share personal information with third-party business partners such as advertising exchanges, data enrichment providers and aggregators, and other entities in the online behavioral advertising ecosystem for purposes of data optimization, lead generation, and other data-based marketing.
Corporate Affiliates. We may share information with companies affiliated with Smack, and they may use that information only for the purposes that are consistent with those described in this Privacy Policy.
Law Enforcement, Legal Process and Compliance. We may disclose personal information or other information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws, in response to a facially valid court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.
Security and Protection. We reserve the right to disclose personal information or other information that we believe, in good faith, is appropriate or necessary to (1) take precautions against liability, (2) protect against fraudulent, abusive, or unlawful uses or activity, (3) investigate and defend ourselves against any third-party claims or allegations, (4) protect the security or integrity of the Site and our products and services and the facilities or equipment used to make those available, or (5) protect our property or other legal rights, enforce our contracts, or protect the rights, property, or safety of others.
Business Transaction Parties. We may share personal information as we believe is reasonably necessary in connection with business transactions such as a transfer or sale to another entity of all or a portion of our stock or assets or other business structure or reorganization transaction.
With Your Consent. We may also share personal information with third parties when we have your consent to do so.
7. how we use cookies and other internet technologies
When you visit our Site, we, and the third-party data analytics, advertising, and social media platforms we authorize, collect data transmitted by internet tracking and data storage technologies. These technologies include cookies, pixels, local device storage, web beacons, scripts, device identifiers, and similar internet mechanisms, which are referred to collectively in this Policy as “cookies.” The types of cookies used on our Site are described below. - Necessary cookies are essential for the Site to operate and cannot be disabled. These cookies do not store your name, email or phone number, IP address or mobile device identifier, or other directly identifying personal information and are deleted when you close your browser.
- Functional cookies enable the Site to personalize certain functions based on actions you take such as remembering your username and password for logging in to your Smack account, language, the region you are in, and your cookie preferences. You can set your browser to alert you to these cookies, but some parts of the Site will not work if you block these cookies.
- Performance cookies enable us to monitor and improve the performance of the Site. For example, they allow us to count visits, identify traffic sources, and see which parts of the Site are visited most often. They are also used for user analytics purposes by storing IP addresses for approximate geographic location. Google Analytics and other providers may create a cookie to identify you as a unique user to track your activities on multiple websites. You can set your browser to alert you to these cookies, but some parts of the Site may not fully function if you block these cookies.
- Targeting and social media cookies. These cookies are set by advertising networks and social media platforms to build a profile of your interests, show your relevant advertisements on other websites, and track when you click on our ads and content displayed on other websites and social media. These advertisers and social media place a cookie or other tracking technology on your browser and device to identify you as a unique user. - Social media cookies use the Meta (Facebook) pixel and other social media cookies to collect, for example, purchase information, web activity, IP address, device and browser characteristics, and timestamps of visits. These cookies help us to analyze the effectiveness of advertisements we post on social media. You can disable these on your browser as described in “How to Restrict Cookies and Targeted Advertising.”
- Email cookies transmit information about how you interact with our email communications such as whether and when you open an email, what links you click within the email, and if you forwarded it.
8. targeted and other advertising
Advertising cookies used on our Site may be set by us or our advertising partners including: (1) advertising exchanges and networks, which collect information about a person’s activities when that person views or interacts with any website where the platform sets cookies or places advertisements; (2) social media platforms, which collect and correlate information about a person identifiable to that platform; (3) attribution partners, which measure the effectiveness of certain advertisements; and (4) business partners, which collect information when a person views or interacts with one of their advertisements or email marketing campaigns.
The data collected using advertising cookies informs us about the activities of our Site visitors and customers including other websites they visit, the ads or links they clicked on, their online purchases, other website actions, and how they responded to our emails. We use this data to develop and improve our marketing strategies and campaigns.
This data also may be used by our advertising partners to build a profile of your preferences and interests and show you advertisements based on your internet browsing activities over time and across many different websites, applications, and platforms you visit and devices you use. “Targeted advertising” is the term commonly used to refer to this type of profile-based, personalized, or interest-based advertising.

Advertising cookies may also be used for retargeting, which is a marketing technique directed to reach previous visitors to our Site and users who have shown interest in our products by responding to our ads and email promotions. Retargeting is also used to limit the number of times you see an advertisement and measure the effectiveness of our advertising campaigns.

You may opt-out of allowing targeted advertising cookies when you visit our Site. If you opt out of targeted advertising, you may continue to see advertisements from us but the ads you see will not be based on a profile of your activities across other websites.
9. how to restrict cookies and targeted advertising
Some ways you can restrict the use of cookies on our Site include:
- Visiting our Manage Preferences link and selecting your privacy settings.
- Managing the preference settings on your web browser or device.
- Configuring your ad and privacy settings through your accounts on social media and advertising platforms where you have an account (for example, Google and Facebook).
- If available, configuring a third-party opt-out preference signal, such as Global Privacy Control if available on your browser or platform to tell us not to sell your personal information or share your personal information for targeted advertising, which we will follow as required by applicable law (for information see https://globalprivacycontrol.org/).
- Installing the Google Analytics opt-out browser add-on, which is described at the Google Analytics Opt-out Browser Add-on page at https://tools.google.com/dlpage/gaoptout.
- Reviewing the privacy policies and practices of the third parties we authorize to collect data on our Site and following their instructions for restricting their data collection.
- Purchasing a utility from an independent software provider that you install on your computer browsers to limit tracking of your browsing activity.
Note that if you restrict the use of cookies, some of the features on our Site may not be fully functional.
Additionally, you may limit the use of mobile device advertising identifiers by adjusting your advertising preferences on mobile devices through your device settings:

Please note that even if you restrict the use of cookies, you will still see advertisements while browsing online. However, the advertisements may be less relevant to your interests.
Do Not Track (DNT) is an optional browser setting that is used by some website operators and third parties. Our Site does not respond to DNT signals.
10. your marketing communications choices
Email Marketing and Advertising. You can opt out of receiving marketing communications from us by following the “unsubscribe” instructions included in each of our email marketing communications. You can also opt out by emailing us at customercare@smackpetfood.com and providing the names/email address that you want us to remove from our marketing database and add to our “Do Not Contact” list. If you opt out of marketing messages, we may still send emails to you that involve your orders or responses to questions. It may take up to ten days to process your request to unsubscribe from email marketing messages.
Text Messages. If you previously gave us permission to send recurring automated promotional and personalized marketing communications to you by text message, you can withdraw that consent at any time by replying STOP to our text message. It may take up to seven days to process your request to STOP text marketing messages.
11. retention of personal information
We will retain your personal information as long as your account is active and for a reasonable follow-on period for internal business purposes and to continue to send marketing information to you unless you direct us to stop. We also retain personal information to comply with our legal obligations, resolve any disputes, and enforce our agreements.
12. protection of personal information
We maintain commercially reasonable security procedures and practices appropriate to the nature of the categories and specific items of personal information we collect. However, neither people nor systems can operate in a fully secure manner and no method of transmission over the Internet or method of electronic data storage is fully secure. While we use reasonable efforts to protect your personal information and select third-party service providers we believe also use reasonable precautions, we cannot guarantee the security of the personal information you provide to us.
Our Site permits you to create an account. When you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else who has obtained your password, even if that person was not authorized by you. You should notify us of any unauthorized use of your password or account, and, if any unauthorized use is suspected, you should immediately reset your password.
If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us of the problem.
13. social media features and links
Our Site includes social media features, such as the “Google Reviews Like” button, and widgets, such as the “Share” button or interactive mini-programs that run on our Site. These features may collect your internet protocol (IP) address, which page you are visiting on the Site, and the social media platform may set a cookie to recognize you and enable the feature to function properly. Your interactions with these features are governed by the privacy practices of the companies that provide them. Please refer to the privacy settings in your social network account for information about what data is shared with connected applications. This Privacy Policy applies solely to information under our control. Smack is not responsible for the privacy practices of the social media platforms you use in connection with our Site.
14. third-party features and websites
The Site may contain links to features or websites operated by third parties. Smack is not responsible for the privacy practices of these third-party features and linked websites. We do not accept any liability or responsibility for these other websites or their policies. We recommend that you review the privacy policies and practices of these third-party websites to learn how they collect and use your personal data.
Third-Party Features. Our Site may use other companies’ applications or platforms to power some features on our Site. For example, we use Shopify to manage our customer portal, credentialing, and online payment processing. Some of these third-party features may be branded with the Smack logo, even though they are not operated or controlled by us. These third-party platforms are able to access and collect data from your use of these features.
Links to Third-Party Sites. Our Site may include links to websites operated by third parties that have information we think may be of interest to you. If you click on a third-party link, you will be directed away from our Site to that third-party website and any information you provide on that third-party website or is collected from your usage, will be available to the third-party operator. The third-party website operator may collect your IP address or device identifier and other internet browsing data, and may set a cookie to enable their features to function and track your usage. We recommend that you review the privacy policies of these websites before sharing any information with them. We have no control over and assume no responsibility for the content, accuracy, privacy policies, or practices of any third-party websites or services.
15. children’s personal information
Our Site is not directed toward children under the age of thirteen (13) years. We do not knowingly collect any personal information about children under the age of 13 without verifiable consent from a parent or legal guardian. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Privacy Policy by instructing their children never to provide personal information through the Site without permission. The data privacy rights of individuals are based on the laws of the state or country where the person resides. We recognize and respond to the following privacy preferences and requests regardless of where you live. We will also honor other privacy rights granted by your place of residence.
Cookie Preferences. We recognize the cookie preferences you select by clicking on the Manage Preferences link on the Site homepage. You can also use the Global Privacy Control (“GPC”), which is a browser-based opt-out preference signal that can communicate your opt-out requests to any website that recognizes the signal. Opt-out of Targeted Advertising. Smack will allow third parties to use cookies to track your usage of our Site for targeted advertising purposes unless you opt-out at our Manage Preferences page. Withdrawing Consent. You can change your privacy and cookie selections by clicking on the Manage Preferences link on the Site homepage. You may withdraw any previously granted consent to use or disclose your personal information at our Privacy Preference link or by contacting us as explained below under “How to Submit and How We Verify a Consumer Request.”
Request to Confirm and Access Information. You may ask Smack (1) to confirm whether we are collecting or otherwise processing your personal information and (2) to access that personal information. When you request access to personal information, you have the right to receive that information in a usable and portable format if technically feasible, and to receive any specific types of information identified in the law of your state of residence.
Request to Correct Inaccuracies. You may ask us to correct information we have that you believe is inaccurate. You can also update or correct certain online account information by logging into your account on our Site.
Request to Delete Information. If you ask us to delete personal information, we will take into account our reasons for keeping that information and any applicable legal standards that apply to deletion requests. We may deny part or all of a request to delete personal information if, for example, it is necessary for completing a transaction, an ongoing business relationship, or legal purposes. If we deny all or part of your request, we will explain the reason for that decision. For technical reasons, and to maintain anonymous business statistics, we may de-identify personal information rather than erase it completely from our systems.

Only you, or someone legally authorized to act on your behalf, may make a request to access, correct, or delete your personal information. Before responding to your request, we may need to verify your identity based on the information we have on file for you, including email address, phone number, full name, address, and other personal information. If you make a request on behalf of someone else, we will need to verify your authority to make that request on their behalf. We reserve the right to deny a request if the identity or authority of the requesting party cannot be confirmed. If we deny or cannot comply with all or part of your request, we will explain the reasons.
How We Respond to Requests for Information. Where applicable laws set a timeframe for responding to consumer requests, we will respond within that timeframe. We may request additional information necessary to verify your identity or that you are authorized to make the request. We try to respond to any verifiable consumer request within 45 calendar days of receiving it. If you have an account with us, we may respond through that account. Otherwise, we will use the email address or U.S. postal address you provided us when making the request.
